Assembly Constitutional Amendment 5
Introduced by Assemblymember Low
February 14, 2023
Revised January 25, 2024

ACA 5 Marriage equality

ACA 5 is, "A resolution to propose to the people of the State of California an amendment to the Constitution of the State,..."

Comments: This resolution is directly tied to a proposition which has qualified to be on the 2024 Fall California General Election ballot titled "California Right to Marry and Repeal Proposition 8 Amendment." If approved, it will change the California Prop 8 language which placed in the California Constitution that marriage is between one man and one woman and would instead place language that recognizes same-sex marriage in the California Constitution. Please note that the U.S. Supreme Court ruling in Obergefell v. Hodges in 2015 has already invalidated Proposition 8.

The authors intent is found in the following article entitled "Proposed Amendment Would Officially End Prop 8."

ACA 5 received broad support from California Democrat assembly members and Democrat state senators, along with one Republican, Assemblymember Greg Wallis District 47, which includes Yucca Valley and Banning Beaumont.

Because this has already qualified to be on the 2024 California Fall ballot, it is too late to contact the author.
